Terms of Service

Effective July 22, 2026

These terms are an agreement between you and MCD LLC, the company that operates Moontuck. They govern your use of Moontuck. By creating an account or starting a free trial, you agree to them. We have tried to write them in plain English. Your use of Moontuck is also governed by our Privacy Policy, which explains how we handle your information. 1. Who can use Moontuck

You must be at least 18 years old, and the parent or legal guardian of any child whose information you add to the service. You agree that you have the right to share that information with us for the purpose of personalizing the stories.

Moontuck is intended for adults. It is set up and operated by a parent or guardian on the child’s behalf — children are not the users of the app or website and should not use it directly. A child enjoys the stories a parent shares with them, but does not log into or interact with the service.

You are responsible for what happens under your account. Keep your password to yourself, and tell us right away if you suspect someone else has access.

Moontuck generates an ongoing personalized bedtime story for your child, delivered by email. Stories are written by an AI model, with automated safety checks and human review: a trained member of our team reads chapters and samples of generated stories to keep them age-appropriate, kind, and safe for little ones. Even so, we cannot guarantee a particular story will perfectly fit every family or every mood. If a chapter ever feels off, tell us; we’ll fix the saga’s direction and use your feedback to improve the safeguards.

Stories are generated for your personal, family use. Re-publishing them as your own work, selling them, or feeding them into a separate commercial product is not allowed.

7. Your library and the chapter emails

While your subscription is active, your library of past chapters is available to you on moontuck.com to read. After cancellation, library access stays open for a 90-day grace window so you can come back without losing visibility into past chapters. After 90 days the library closes.

Separately from library access, each chapter you receive arrives as an email in your inbox. Those emails are yours to keep in your personal email archive — we don’t ask you to delete them when your subscription ends. The stories insidethose emails remain Moontuck’s intellectual property under the license described in Section 9; you keep the emails as a personal record of what your family received, not as a license to redistribute the story content.

9. Intellectual property and copyright

9.1 What belongs to Moontuck

The Moontuck brand, website, design, code, story prompts, character archetypes, theme worlds, story bibles, saga master content, underlying generative systems, and all related materials are the exclusive property of MCD LLC and are protected by copyright, trademark, trade secret, and other intellectual property laws of the United States and other countries. Nothing in these terms transfers ownership of Moontuck’s creative system to you.

9.2 What we license to you

While your subscription is active (and during the 90-day post-cancellation grace window described in Section 7), we grant you a narrow, non-exclusive, non-transferable, royalty-free, personal license to:

Each chapter email delivered to you also sits in your personal email inbox as a record of what your family received. You keep those emails in your inbox archive for your own reference; we don’t ask you to delete them. That said, the stories insidethe emails remain Moontuck’s intellectual property and the prohibitions in Section 9.3 below still apply to that content (no AI training, no republishing, no derivative works, etc.) regardless of whether you access the chapter via the library or your inbox.

The license does not include the right to print or photocopy chapters, save chapters to local or cloud storage as separate files, screenshot or export chapters into other documents, or transcribe chapters into other formats (audio, video, print zine, etc.) — beyond the natural fact that chapter emails remain in your inbox.

This license is strictly for personal, non-commercial family use within your household. It does not extend to anyone outside your household.

9.3 What you may not do with Moontuck stories

You agree that you will not:

Violation of these restrictions terminates your license immediately, may result in suspension or termination of your account, and may subject you to legal action for copyright infringement, breach of contract, and any other available remedies. Each unauthorized use may be treated as a separate breach.

9.4 Uniqueness and traceability

Each Moontuck chapter is uniquely generated for your family and is identifiable to the household that received it. We retain delivery logs sufficient to determine which family any given chapter was sent to. If we discover Moontuck content published or shared without authorization, we can identify the source.

9.5 The underlying creative system

The story prompts, character names, theme worlds, saga master libraries, narrative bibles, principle queues, and review pipelines that power Moontuck are our proprietary creative and technical system. We may use the same underlying characters, themes, and saga structures across many families; the specific generated text delivered to your child is uniquely yours within your household, but the underlying creative scaffolding belongs to us in all cases.

9.6 Reporting infringement / DMCA

If you believe Moontuck content has been used in violation of these terms or in violation of your copyright, write to contact@moontuck.com with the URL or location of the alleged infringement and a description of the issue. We will investigate within 7 business days. If you believe Moontuck content infringes your own copyright, send a notice meeting the requirements of the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3), to the same address.

9.7 Feedback and steering submissions

Story preferences, steering nudges, and feedback you submit through Moontuck are licensed to us on a non-exclusive, royalty-free, perpetual basis for the purpose of improving the service. We will not publish your steering submissions verbatim or attribute them to you.

10. Disclaimers

Moontuck is provided “as is” and “as available”. We do our best to keep the service running and the chapters arriving on time, but we don’t warrant that delivery will be uninterrupted, error-free, or perfectly suited to every child. The stories are bedtime entertainment, not professional advice of any kind.

11. Limitation of liability

To the fullest extent allowed by law, Moontuck and its team are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service. Our total liability to you for any claim related to the service is limited to the amount you paid us in the 12 months before the claim, or $50, whichever is greater. Some jurisdictions don’t allow these limits, so they may not apply to you.

12. Indemnification

You agree to defend and hold Moontuck harmless from claims arising out of your misuse of the service or your violation of these terms.

13. Termination

You can close your account at any time. We can suspend or close accounts that violate these terms, that put other users at risk, or that we are required to close by law. If we do, we will refund any unused prepaid time unless the violation was serious.

14. Changes to these terms

We will update these terms from time to time. If a change is material, we will email you and post a notice on the site before it takes effect. Continuing to use Moontuck after the change means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Missouri, and you agree to that jurisdiction.
